Jehovah's Witness/bloodless checklist?
I am in process of developing a checklist for patients to fill out to clearly delineate any "bloodless" wishes. I'm fairly certain this has been done before and don't wish to re-invent the wheel, so if anyone would like to share their checklist with me I'd be graciously accepting! ( I am a perfusionist who is tired of learning of the patient's wishes after the patient is asleep in the OR, and I hear secondhand from the anesthesiologist that "Oh, yea, he will accept this and that" with no further details!)

3/1/2008: Since the laws change so quickly, and, you have to keep up with not only your own State's laws but also Federal laws, which supercede State laws, there are web-sites to help you keep abreast of changes and cases to read that are timely. While in college, we discussed the problems concerned with Living Wills (Advance Directives) in connection with Probate issues. Here are a few web-sites that were functioning awhile back. If you have trouble linking, let me
know so I can make sure of it, as these were given in paralegal instruction materials: findlaw.com; lawcornell.edu; lawschool.lexis.com. There are more if you are able to buy a library card to any California State University. They usually allow their patrons to research-their searchengines are great and you can check all the sections of law that may apply to any checklist that you make so everything is legal. If you mail out examples of your checklist, please share them. |

It is my understanding that Federal law CAN trump state law, only if it is specifically
worded to do to so. There are a number of statutes on the books that if a state law is stricter, AND is NOT pre-empted by federal law, (again - wording of federal law) then the stricter state law applies. Just wanted some clarification.
